Brandesign, based in Wormerveer (the Netherlands), is responsible for the processing of personal data as described in this privacy policy. We process your data carefully, securely and in accordance with the General Data Protection Regulation (GDPR) and — for visitors from the United Kingdom — the UK GDPR.

What data do we process?

We only process data you provide to us yourself or that is needed to make the website work properly:

• Contact and quote requests: name, email address, phone number (optional), company name (optional), subject and the content of your message.
• Free website scan: your email address and the URL of your website.
• WhatsApp contact: if you get in touch via the WhatsApp button, WhatsApp (Meta) processes your data according to their own privacy policy.
• Customer and invoice details: for an assignment we process the data needed for delivery and administration (name, address, KvK/VAT details, payment details).
• Technical data: IP address, browser type and visited pages, via security and server logs and — only with your consent — analytics cookies. See our Cookie policy.

What do we use your data for?

• Answering your question or quote request (legal basis: legitimate interest / pre-contractual phase).
• Performing a contract, including invoicing (legal basis: performance of contract and legal obligation).
• Improving and securing our website (legal basis: legitimate interest).
• Statistics and marketing, only after your consent via the cookie banner (legal basis: consent).

We never use your data for automated decision-making and never sell your data to third parties.

How long do we keep your data?

• Contact and quote requests: a maximum of 2 years after the last contact, unless an agreement follows.
• Customer and invoice details: 7 years, in line with the tax retention obligation of the Dutch Tax Authority.
• Analytics data: in line with the periods in our Cookie policy.

Who do we share data with?

We only share data with parties needed for our services (processors), such as our hosting provider, email service and — if active and with your consent — analytics services such as Google Analytics. We conclude processor agreements with processors. When data is processed outside the European Economic Area (for example by US service providers), this is done on the basis of appropriate safeguards such as the EU-US Data Privacy Framework or standard contractual clauses (SCCs).

Security

We take appropriate technical and organisational measures: an encrypted connection (SSL/TLS), secure hosting, access restrictions, up-to-date software and periodic backups.

Your rights

You have the right of access, rectification, erasure, restriction of processing, data portability and objection. You can always withdraw consent you have given. Send your request to studio@brandesign.nl; we respond within one month. To prevent misuse, we may ask you to prove your identity.

Do you disagree with how we handle your data? We would like to hear about it from you first. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Netherlands) or — for visitors from the UK — with the Information Commissioner’s Office (ICO).

We may amend this privacy policy. The current version is always available on this page. For significant changes we will inform you via the website.
